This Privacy Policy is the basic document defining principles and norms that NorDan uses when collecting and storing personal information of individuals (hereinafter "Users") visiting www.nordan.pl website. In connection with visiting www.nordan.pl website by Users, NorDan processes shared information (personal information/personal data), i.e. information enabling direct or indirect identification of person, in particular:

V. Do we process information in an automated way? Do we transmit information outside the European Economic Area?

Personal information collected by NorDan are stored only within the European Economic Area. NorDan does not process personal information in an automated way (including “profiling”).

VI. Who is the recipient of personal information? With whom we share your personal information?

The recipients of Users' personal information are primarily entities processing personal information on behalf of NorDan based on separate contracts - these include IT service and website operators that help in managing www.nordan.pl website. The recipients will also be other entities being a part of the NorDan Gruppen AS group, however only to the extent resulting from the provisions of generally applicable law. In cases provided for by law and based on a legitimate request, personal information will also be transferred to other recipients, e.g. public authorities, administrative bodies, justice system, Police. Personal information may also be disclosed at the request of person concerned.

VII. Is personal information provided voluntarily?

Providing any personal information is voluntary and depends on the will of the Users. However, it should be noted that providing personal information will be necessary, e.g. when attempting to contact NorDan by email - refusal to provide data will prevent contact being established.

VIII. What are the rights of Users?

Every User whose data is processed by NorDan has a number of rights, including:

Right to access information and in this regard to obtain a copy of information processed by NorDan

Right to request correction of data processed by NorDan (rectification)

Right to request data deletion - in cases provided for by law, when there are no legal grounds for further processing of personal information by NorDan

If processing of personal information is based on consent, right to withdraw consent, with proviso that withdrawal of consent does not affect the lawfulness of earlier data processing, before consent withdrawing.

Right to transfer data, i.e. the right to receive data from NorDan, in a structured, commonly used machine-readable format, and right to send this data to another data administrator (in cases provided for by law)

Right to object to data processing

Right to lodge a complaint to the supervisory body (President of the Personal Data Protection Office) in the event of a violation of rights in processing of personal information.

IX. For how long do we keep your information?

NorDan undertakes to process Users' personal information only for period necessary to achieve certain purposes. After expiry of such period, data will be irreversibly destroyed or deleted and NorDan will not be able to process it further.

Data processed to fulfill concluded contract is stored for the time necessary to its fulfillment. In the event that fulfillment of the contract fails, personal information will be stored for 3 years from the date of its collection.

NorDan stores also archival data. After given legal relationship expires, personal data of natural persons (individuals), including personal information regarding operating of these individuals on behalf of the entrepreneur, institution or organizational units are stored for a period of 6 years.

In the event of a dispute, trial or other proceedings, archiving period will be counted from the date of termination of the dispute, regardless of manner in which it is terminated, or the final conclusion of the last proceeding, unless the law provides for a longer limitation period for a given right / claim in question.

Personal information collected on the basis of consent NorDan will store for period indicated in the statement of consent or until the consent is revoked.

Personal data processed on the basis of a legitimate interest, in particular for the purpose of direct marketing, will be stored until objection to such processing.

In order to demonstrate accountability, personal data will be stored for period in which NorDan is required to store it in electronic or paper form, to document compliance with legal requirements and to enable control by authorized entities.

X. What are the legal grounds for personal data processing?

Legal basis for processing of Users’ personal information are:

art. 6 clause 1 letter b of GDPR (ie. processing is necessary to fulfill agreement to which the User is a party, in case of cooperation between NorDan and the User), i.a. implementation of sales transactions, handling of inquiries submitted by e-mail, phone and on social media, handling of complaints.

art. 6 clause 1 letter a of GDPR (ie. processing is based on the User’s voluntary consent, regardless of whether the parties would go into cooperation), i.a. marketing purposes, saving data in cookies, recruitment process

art. 6 clause 1 letter c of GDPR (ie. Processing is necessary to fulfill legal obligation, i.a. archiving obligation, obligation to make tax settlements, obligation to provide authorized entities with answer to inquiry)

art. 6 clause 1 letter f of GDPR (ie. processing is necessary to establish, pursue or defend claims, is justified by legitimate interest of the Administrator and by purpose of processing), i.a. providing Users of www.nordan.pl with the best information transfer, ensuring the best way of contact with NorDan.

XI. What means do we use to protect personal information?

NorDan makes every effort to ensure that personal information of Users' visiting www.nordan.pl website are properly secured and processed in accordance with requirements of law, including the GDPR. NorDan uses only assistance of entities ensuring proper processing of personal data, obliged to act appropriately on the basis of concluded written personal data processing agreements. NorDan uses IT and technical security means to prevent unauthorized access to data.

XII. Final provisions.

To the extent not covered by this Privacy Policy, provisions regarding the protection of personal data shall apply. In case of a change to the Privacy Policy, information about such changes will be available on the main website www.nordan.pl.
